The legal dispute began in 2021 when Brooklyn-based Van Leeuwen accused Rebel Creamery of copying the appearance of its ice cream packaging. The lawsuit focused on Rebel’s use of a similar monochromatic pastel design and black script lettering on its pints.

The case eventually went to trial in the Eastern District of New York. In July 2026, U.S. District Judge Eric Komitee ruled that Rebel had intentionally infringed on and diluted the appearance of Van Leeuwen’s products. The ruling ordered Rebel to give up $23.8 million in profits connected to the dispute.

Rebel Ordered to Change Its Packaging

Along with the financial judgment, the court ordered Rebel Creamery to stop selling the products involved in the lawsuit and redesign their packaging. The decision created significant financial pressure for the company as it continued operating under the consequences of the ruling.

Rebel’s bankruptcy filing lists its estimated assets and liabilities between $10 million and $50 million. The company had not immediately responded to a request for comment when the Houston Chronicle reported the bankruptcy.
